RESOLVED UNANIMOUSLY

That the application for deletion of condition 13 of the township approval dated 1 March 2000, and amendment of conditions 12 of the same approval, in respect of Erf 15025, Brackenfell, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, in accordance with Plan No 96031/C17(A) / PN 0362/2001 (see Annexure C), previously approved by the City on 3 May 2001, subject to conditions attached as Annexure A.

APPLICATIONS GRANTED IN TERMS OF SECTION 98(b) OF THE BYLAW

Application granted is amended as follows:

Amendment of condition 12 as per 1.2 below and deletion of condition 13 of the township approval dated 1 March 2000

CONDITIONS IMPOSED IN TERMS OF SECTION 100(10 OF THE MUNICIPAL PLANNING BYLAW, 2015

Condition c is amended as follows;

d. That the signage board of appropriate size consistent with the Gated Development Policy be installed at the secondary gate, in accordance with the wording below:



Condition e is amended as follows;

e. That the Owners’ Association will be responsible for the clean-up of any litter near the access gate and ensuring that no loitering occurs near or on the property, and reporting any such contraventions to appropriate authorities.

REASONS FOR DECISION:

1. The proposal will alleviate existing traffic experienced at the main access gate and the traffic-circle on Belami Close;
2. The proposal will allow for a more balanced dispersal of traffic within Kleinbron Park and to/from the surrounding area;
3. The public’s right to access to public roads and public open spaces within Kleinbron Park will not be jeopardized, but protected by conditions
4. The development contains more than 250 residential units, which necessitates a second access point in terms of the Gated Development Policy, especially in cases of emergencies;
5. The proposal is compatible with the Transport Orientated Development Framework by providing easy access between Kleinbron Park and economic activities along De Bron Crescent and Cape Gate Shopping Centre;
6. Traffic calming/speed bumps have been installed in Sheba Street to address past concerns of neighbours in terms of pedestrian/traffic safety;
7. Approved building plans, access control infrastructure and the correct zoning is already in place to accommodate the proposal;
8. The proposal is supported by the department responsible for imposing the original conditions of approval, namely the City’s Engineering Department (TDA: TIA and Development Control, and Asset Management/Maintenance).
9. Based on the above, the proposal is not considered to impact negatively on the general safety, health and wellbeing of residents within or outside of Kleinbron Park and is considered to be in line with the considerations of Section 99 of the Bylaw, in supporting the application.
