RESOLVED UNANIMOUSLY
a. That the application for the removal of the restrictive title deed conditions, C(d) of Title Deed T115964/2004 to allow for the deletion of the street building line restriction in respect of Erf 915, Gordon’s Bay, BE APPROVED in terms of Section 98 (b)(i) of the Cape Town Municipal Planning By-Law,2015.
b. That the application for departure for relaxation of the 1,5m maximum permissible distance for windows to 1m in respect of Erf 915, Gordon’s Bay, BE APPROVED in terms of Section 98 (b)(i) of the Cape Town Municipal Planning By-Law,2015.
c. That the application for departure for relaxation of the 1,5m street building line to 0m for the purpose of erecting a carport in respect of Erf 915, Gordon’s Bay, BE APPROVED in terms of Section 98 (b)(i) of the Cape Town Municipal Planning By-Law,2015.
d. That the application for departure for relaxation of the 3,5m street building line to 0m for the purpose of erecting a covered patio/stoep in respect of Erf 915, Gordon’s Bay, BE APPROVED in terms of Section 98 (b)(i) of the Cape Town Municipal Planning By-Law,2015.
e. The application for departure from the 3m common building line requirement for 40% of the length of common boundary (excluding the first 12m) to allow for covered patio at 0m for a length of 7,61m in respect of Erf 915, Gordon’s Bay, BE REFUSED in terms of Section 98 (c) of the Cape Town Municipal Planning By-Law, 2015, but that such structure to 0m BE APPROVED in terms of Section 98 (b) of the Cape Town Municipal Planning By-law, 2015 for the portion of the of the roofed patio structure on the South Eastern common boundary incorporating the built braai as well as the supporting brick pier on the North Western side of the structure in order to facilitate open access to the sewer connection point at the rear of the property,
NEW CONDITION
1. That a revised Site Plan be submitted reflecting the amendment of the patio structure at the rear end of the property in order to facilitate open access to the sewer connection point.
REASONS FOR DECISION:
The MPTNE Panel approved the applications for the reasons as set out in the planner’s report and added an additional reason that reads as follow:
6. That the retention of the existing built braai, brick pier and roof structure covering such portions has no negative impact of the existing rights of neighbours.
