UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 41 689.00 BE APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 13313 Constantia, for the unauthorised building work as per the plan drawn by GM Design Studio with drawing number 1401-01 Revision E.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reason 5 as follows:
Given that the owner was in the process of submitting plans for the gatehouse and garage, it is evident that the owner was aware that the additional building work required a planning approval process.
