UNANIMOUSLY RESOLVED that:
a. The application for rezoning of the portion of Erf 96664 Cape Town at Newlands currently zoned Community Zone 1 to General Business Subzone GB1, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to conditions contained in Annexure A.
b. The application for departures, as set out in Annexure A, for Erf 96664 Cape Town at Newlands, BE APPROVED in terms of 98(b) of the Municipal Planning, By- Law 2015.
c. The application for Council’s approval in terms of Item 60(k)(ii) of the Development Management Scheme to permit the parking bays at ground floor level to be located closer than 10m to a street boundary, as set out in Annexure A, for Erf 96664 Cape Town at Newlands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
d. The application for Council’s approval in terms of Item 141(1)(b) of the Development Management Scheme to permit vehicles to reverse accross the sidewalk, as set out in Annexure A, for Erf 96664 Cape Town at Newlands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
AMEND CONDITIONS:
4.1.1 The property shall only be used as a museum, museum shop, dwelling(s), office and restaurant
4.1.2 The owner shall submit to the Director: Development Management formal building plans showing the conversion of the unapproved portions of the building to its current uses
4.1.3 The hours of operation of the restaurant shall not exceed 20:00 – until a noise management plan compiled by a registered acoustic engineer, as provided for in Condition 4.2.1 below, is submitted, approved and implemented to the satisfaction of the Director: Health.
4.1.4 Even with a Noise Management Plan, the hours of operation of the restaurant shall not exceed 23:00.
4.1.5 No amplified live music shall be permitted in the restaurant
