RESOLVED UNANIMOUSLY
a) That an administrative penalty in terms of Section 129 of the City of Cape Town Municipal Planning By-Law; 2015 equal to R1000.00, BE APPROVED for the unauthorized building work and for the unauthorized land use activity on the property .
REASONS FOR DECISION:
1. The property owner applied for consent to operate the ECD and acknowledged the unlawful activity not as a result of a notice being issued but to comply with regulations.
2. There have been no complaints regarding the crèche.
3. The provision of ECD facilities is very important in terms of the social benefits to the surrounding communities.
