RESOLVED UNANIMOUSLY
a. That the application for permanent departures to permit the north western retaining walls to be 2.95m within the common boundary building line, on Erf 16104, Kuils River, BE APPROVED.
b. That the application for permanent departures to permit south western retaining walls to be 2.7m high in lieu of 2.0m within the common boundary building line, on Erf 16104, Kuils River, BE REFUSED.
REASONS FOR DECISION:
Reasons for Approval of the north western retaining wall
1. The proposed development will not have a negative impact on the character of the area and the land use is compatible with the surrounding residential area.
2. No negative impact is expected on the safety, health and wellbeing of the surrounding community.
Reasons for Refusal of the south western retaining wall
1. The impact of the height departure would have an unacceptable impact on the existing rights of neighbors.
2. The height departure is not essential for the structural integrity of the dwelling and alternative design options need to be explored.
