RESOLVED UNANIMOUSLY

a. That the application for consent use in terms of Section 42(i) of the City of Cape Town, Municipal Planning By-Law, 2015 in order to permit a house shop to operate from a portion of Erf 1989, 2 Mitchell Avenue, Weltevreden Valley, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A.

b. That a temporary departure in terms of Section 42(c) of the City of Cape Town, Municipal Planning By-Law, 2015, for the preparation and sale of prepared meals from a portion of erf 1989, 2 Mitchell Avenue, Weltevreden Valley, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A.

c. That the application for a departure in terms of Section 42(b) of the City of Cape Town Municipal Planning By-Law, 2015 in order to permit a street building line of 0.8m in lieu of 3.5m for the take-away, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with plan contained in Annexure C.

CONDITIONS IMPOSED IN TERMS OF SECTION 100 OF THE CAPE TOWN MUNICIPAL PLANNING BY-LAW, 2015

TRANSPORT AND URBAN DEVELOPMENT AUTHORITY

Condition 2.4 and 2.10 is amended as follows:

2.4 That the take-away herby permitted shall operate between the hours of 10:00 to 20:00 and that the house shop shall not operate outside the hours of 07:00 to 21:00 on Mondays to Saturdays and 08: 00 to 13:00 on public holidays or Sundays.

2.10 The temporary departure approval for the take-away shall be valid for a period of two years from the date of final notification.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report.
