RESOLVED UNANIMOUSLY
That the application for subdivision of Portion 4 of Cape Farm 1098 into two portions as per the attached plan of subdivision (Annexure C) BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A.
CONDITIONS OF APPROVAL IMPOSED IN TERMS OF SECTION 100 OF THE BY-LAW
PROVINCIAL ROADS ENGINEER
Condition 2.16 and 2.17 be amended as follows:
2.16 Only one access to each portion is retained, viz Remainder via P Minor Road 111, and Portion 1 via PDR 1101, the other ‘gate accesses’ being permanently closed.
2.17 The geometrics and materials design plans of any access upgrades, having been scrutinized by the affected Directorates of the City of Cape Town, are submitted to the Provincial Roads Engineer’s Design Directorate for final approval.
REASONS FOR DECISION:
1. The proposal is in accordance with the applicable spatial development frameworks, i.e. the Municipal Spatial Development Framework and the Northern District Plan.
2. The proposed land-use is compatible with surrounding land-uses and will not compromise agricultural or mining activities in the area.
3. Subdivision will not have any adverse impact on the safety, health or wellbeing of the surrounding community and it will not have a negative impact on existing rights.
4. Approval of the application will have a positive socio-economic impact.
5. The proposal does not have any negative heritage or environmental impact.
6. The application complies with the Subdivision of Agricultural Act: Act 70 of 1970.
