RESOLVED UNANIMOUSLY:
a. That the application for consent use in terms section 42(i) of the City of Cape Town, Municipal Planning By-Law, 2015 in order to permit the erection of a place of worship (church) on Erf 109, 5 Elgar Avenue, Ikwezi Park, Mandalay, BE REFUSED in terms of Section 98(c)(iii) of the of the City of Cape Town, Municipal Planning By-Law.
b. That the application for permanent departures, as set out in Annexure A, in terms of section 42(b) of the City of Cape Town, Municipal Planning By-Law, 2015, on Erf 109, 5 Elgar Avenue, Ikwezi Park, Mandalay, BE REFUSED in terms of Section 98(c) of the City of Cape Town, Municipal Planning By-Law, 2015.
REASONS FOR DECISION:
1. The proposal does not enhance the residential precinct within which it is located.
2. Traffic congestion in the cul-de-sac is not considered to be desirable.
3. The locational context does not merit the use of the property for a higher order use.
4. It is not compatible with the surrounding residential properties.
5. The scale of the proposal is out of keeping with the size and shape of the property.
6. The proposed mitigation is deemed not desirable.
