RESOLVED that:
a. The application for the subdivision of Erf 5623 Hout Bay, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as per plan of subdivision LUM/33/5623, subject to the conditions contained in Annexure A.
b. The departure, as set out in Annexure A, for Erf 5623 Hout Bay, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION:
1. The proposal will not significantly change with the character of the area and will not have a significant negative impact on neighbouring properties.
2. The level of densification proposed is low and is contextually appropriate.
3. The size of each portion is reasonable within this context and is large within a City context.
4. The proposal complies with the Southern District Plan and the Densification Policy, and is consistent with the Cape Town Spatial Development Framework.
5. There is adequate infrastructural capacity for the proposal.
6. The transport impact will be negligible.
7. The proposal will have a positive socio-economic impact.
8. The proposal will not have a negative impact on the streetscape.
9. The proposal is desirable and does not impact on existing rights.
