UNANIMOUSLY RESOLVED that:
a. The applications for departures, as set out on Annexure A, for Erf 2099 Green Point BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A.
b. The application for City approval in respect of the Heritage Protection Overlay Zone and the 5,0m metropolitan road in terms of the Development Management Scheme, as set out in Annexure A, on Erf 2099 Green Point, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, subject to the conditions contained in the attached Annexure A.
REASONS FOR DECISION
1. The application is compliant with the Table Bay District Plan, Transit Orientated Development Framework and Urban Design policies.
2. The building has been designed to reduce its impact on the surrounding erven and is compatible with the surrounding built form.
3. Minimal adverse impacts will be caused on the immediate area.
4. The streetscape will be improved and be sensitive to the local context.
5. Conditions have been imposed to mitigate potential impacts.
6. Although the development is located in a heritage protected zone there are no specific provisions that would cause the MPT to refuse this application
7. The proposal is consistent with the City’s policy on increasing density in areas where it is appropriate
8. The height of the building is within the DMS limits for GR4 and GR5 zones
AMENDMENTS TO CONDITIONS:
1.12 To permit 96 bays in lieu of 104 parking bays
Delete note on Annexure A: ‘This approval is linked to the plans drawn by Bam Architects dated 14/11/16’.
The final location of the generator room must be done in consultation with the Director: Development Management
