RESOLVED UNANIMOUSLY:

a. The application for the removal of the restrictive title deed conditions, Clause D4 (b & d) of title deed T73150/2002 in respect of Erf 1425, Somerset West, BE APPROVED in terms of Section 98 (b)(i) of the Cape Town Municipal Planning By-Law,2015

b. The application for the departure to permit a relaxation of the 5m street boundary building line (Firmount Road) to 4,5m to allow for a garage as indicated on plan 1425 A234 dated February 2016 in respect of Erf 1424 Somerset West BE APPROVED in terms of Section 98(b) (i) of the Cape Town Municipal Planning By-Law.

c. The application for the departure to permit a relaxation of the 5m street boundary building line (Hertzog Road) to 4,5m to allow for a carport as indicated on plan 1425 A234 dated February 2016 in respect of Erf 1424 Somerset West be approved in terms of Section 98(b) (i) of the Cape Town Municipal Planning By-Law
d. The application for the departure in terms of Section 126(a) to allow for the ground floor of a building to be raised more than 1,5m from existing ground level to 1,62m as indicated on plan 1425 A234 dated February 2016 in respect of Erf 1425 Somerset West be approved in terms of Section 98(b) (i) of the Cape Town Municipal Planning By-Law.


REASONS FOR DECISION:

1. The proposal is consistent with council policy
2. The street building line encroachment is minimal and will not have a noticeable impact on the streetscape.
3. The ground floor is not significantly raised (0,12m) and it is line with the character of the area, since there are similar developments in the area.
4. The proposal will not adversely impact on the character of the area (neighborhood) and a safe and pleasant environment could still be enjoyed without any financial or other loss to the surrounding community.
5. The owner stands to gain from the removal in terms of improving his current dwelling and possibly generating an additional income.
