UNANIMOUSLY RESOLVED that:
a. The application for deletion of a restrictive condition, as set out in Annexure A, for Erf 110909 Cape Town at Rondebosch, BE APPROVED in terms of Section 98(b) of the Municipal Planning By- Law, 2015.
b. The application for departure, as set out in Annexure A, for Erf 110909 Cape Town at Rondebosch, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
c. The application for Council’s approval in terms of item 162(1) of the Development Management Scheme to permit demolition and building work in a Heritage Protection Overlay Zone, for Erf 110909 Cape Town at Rondebosch, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION
1. The proposal will not change the character of the area and will not have a negative impact on neighbouring properties.
2. The proposal is consistent with the Southern District Plan and the Cape Town Spatial Development Framework.
3. The proposal has no negative socio-economic impact.
4. The proposal is desirable and does not impact significantly on existing rights
5. There will be no heritage impact and Council’s Heritage Resource Management Section has no objection.
6. The proposal fits in with the wide mix of building forms found in the area. The addition is small and it is efficiently designed to make use of the limited space available on the small property. The building height is modest with the roof space being used for part of the first floor. The building height of the extensions will be lower than the height of the existing structures on the property.
7. The proposal will have no impact on the biophysical environment.
8. There will be no traffic impact.
9. It complies with the legal provisions of SPLUMA and LUPA
10. The proposal is substantially less than what is permitted in a GR 2 zone
