RESOLVED that:
a. The application for deletion and amendment of restrictive title deed conditions, as set out in Annexure A, for Remainder Erf 65915 Cape Town at Kenilworth, BE APPROVED in terms Section 98(b) of the Municipal Planning By-Law, 2015.
b. The application for amendment and deletion of conditions of an existing approval, for Remainder Erf 65915 Cape Town at Kenilworth, as set out in Annexure A, BE APPROVED in terms Section 98(b) of the Municipal Planning By-Law, 2015.
c. The application for subdivision of Remainder Erf 65915 Cape Town at Kenilworth, BE APPROVED in terms Section 98(b) of the Municipal Planning By-Law, 2015, in accordance with plan of subdivision LUM/00/65915, subject to conditions contained in Annexure A.
d. The application for rezoning of the Remainder of Remainder Erf 65915 Cape Town at Kenilworth, as shown on plan of subdivision LUM/00/65915, from Single Residential Zone 1 to General Residential Subzone 2, BE APPROVED in terms Section 98(b) of the Municipal Planning By-Law, 2015, subject to conditions contained in Annexure A.
e. The application for departures, as set out in Annexure A, for Remainder Erf 65915 Cape Town at Kenilworth, BE APPROVED in terms Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION
1. The proposal is consistent with the Cape Town Spatial Development Framework, and complies with the Southern District Plan, the Transit Orientated Development Strategic Framework, the Densification Policy, the Urban Design Policy and the Gated Development Policy.
2. The proposal is consistent with the character of the area and will not have a significant negative impact on neighboring properties.
3. The proposal is of an appropriate scale and form that relates to the broader urban fabric.
4. The proposal amounts to contextually appropriate densification which provides for the changing needs of the inhabitants of the City.
5. The proposal will not have a negative impact on the environment and on the streetscape and an EIA was not required.
6. The proposal will not have a negative heritage impact and that it is supported by Council’s Heritage Department and by Heritage Western Cape.
7. Adequate municipal services are available.
8. Adequate on-site parking will be provided and the proposal will not have a significant negative impact on traffic.
9. The approval of the application does not impact on any existing rights and does not lack desirability.
10. The proposal complies with the legal requirements for the removal of restrictions in the title deed of the property
