UNANIMOUSLY RESOLVED:

a. That the application for the subdivision of Remainder Erf 8433 Goodwood into two portions (Portion A and Remainder) BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015, in accordance with the subdivision plan, attached as Annexure C, and subject to the conditions contained in the attached Annexure A.

b. That the application for the subdivision of Remainder Farm 435 Goodrail into two portions (Portion A and Remainder) BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015, in accordance with the subdivision plan, attached as Annexure C, and subject to the conditions contained in the attached Annexure A.

c. That the application for the subdivision of Erf 3003 Epping Garden Village into two portions (Portions A and Remainder) BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015, in accordance with the subdivision plan, attached as Annexure C, and subject to the conditions contained in the attached Annexure A.

d. That the application for the rezoning of the subdivided Portion A of Erf 8433 Cape Town from Transport Zone 1: Transport Use (TR1) to General Residential Subzone 4 (GR4) BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in the attached Annexure A.
e. That the application for the rezoning of subdivided Portion A of the Farm 435 Goodrail from Transport Zone 1: Transport Use (TR1) to General Residential Subzone 4 (GR4) BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in the attached Annexure A

f. That the application for the rezoning of the subdivided Portion A of Erf 3003 Epping Garden Village from Open Space Zone 2: Public Open Space (OS2) to Transport Zone 2: Public Road and Public Parking (TR2) BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in the attached Annexure A.

g. That the application for the consent use to permit a portion of Remainder Erf 8433 Cape Town and portion of Remainder Farm 435 Goodrail for shops, BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in the attached Annexure A.

CONDITIONS OF APPROVAL IMPOSED IN TERMS OF SECTION 100 OF THE BYLAW

ENGINEERING SERVICES

Conditions 2.18 to be amended as follows:

2.18 That the Developer may enter into a services agreement with the City of Cape Town to install or upgrade bulk municipal services at an agreed cost, to be offset against development charges payable in respect of bulk civil engineering services. That electricity capacity is made available for the development.

Condition 2.25 is deleted.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planners’ report.
