UNANIMOUSLY RESOLVED
a. That the application for a consent use in terms of Section 42(i) of the Municipal Planning By-Law 2015 to permit a 25 m freestanding base telecommunication station on a portion of Erf 9262, Durbanville near the Legato Drive / De Villiers Avenue intersection, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, in accordance with Plan No CTC-9262 Rev 0 attached as Annexure C, subject to the conditions contained in Annexure A.
b. That the application for Council`s consent in terms of condition 3 of Title Deed T77835/2000 and Section 42(h) of the Municipal Planning By-Law 2015 to utilize a portion of Erf 9262, Durbanville near the Legato Drive / De Villiers Avenue intersection for the purposes of a 25 m freestanding base telecommunication station BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, in accordance with Plan No CTC-9262 Rev 0 attached as Annexure C
CONDITIONS OF APPROVAL IMPOSED IN TERMS OF SECTION 100 OF THE BYLAW
LAND USE MANAGEMENT
Condition 2.1 to be amended as follows:
2.1 That the base station shall be located in accordance with the plan as approved by the Director: Development Management.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planners’ report.
