UNANIMOUSLY RESOLVED
a) The application for Section 42(b) – Permanent Departure in respect of Erf 11843, Bellville for the relaxation of the two street building lines from 4.5m to 0.0m to permit a five storey building BE APPROVED in terms of 98(b) of the City of Cape Town Municipal Planning By-Law in accordance with the Site Plan, attached as Annexure C, subject to conditions, attached as Annexure A.
b) The application for Section 42(b) – Permanent Departure in respect of Erf 11843, Bellville for the relaxation of the parking requirement from 207 to 77 bays provided BE APPROVED in terms of 98(b) of the City of Cape Town Municipal Planning By-Law in accordance with the Site Plan, attached as Annexure C, subject to conditions, attached as Annexure A.
c) The application for Section 42 (b) – Permanent Departure in respect of Erf 11843, Bellville for the relaxation of the permissible floor factor from 2.0 to 2.18 BE APPROVED in terms of 98(b) of the City of Cape Town Municipal Planning By-Law in accordance with the Site Plan, attached as Annexure C, subject to conditions, attached as Annexure A.
NEW CONDITION IMPOSED IN TERMS OF SECTION 100 OF THE CITY OF CAPE TOWN MUNICIPAL PLANNING BY-LAW.
LAND USE MANAGEMENT
2. That particular attention be given to the street interface and landscaping along principal street, within the SDP to the satisfaction of the Director: Development Management.
REASONS FOR DECISION:
The proposed use is seen to be desirable within its context as it ties in with existing uses and the general character of the surrounding area.
1. The development should not have any material negative impact in addition to what the existing land-use rights already allows, on existing, surrounding property rights in terms of views, overshadowing and engineering services currently available in the area.
2. The TCT: Integrated Transport Planning department supports the parking departure application, given the location of the property being in close proximity to a major, existing Transport route with commuter facilities (busses and taxis) being operational on a daily basis.
3. It is consistent with Council’s policy towards appropriate densification and transport oriented development.
