UNANIMOUSLY RESOLVED

That the application for the determination of an administrative penalty in respect of Erf 2354, Kuilsriver be imposed to the amount of (5% of the Municipal value of the property) R 72 500.00 in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015.


REASONS FOR DECISION:

1. The scale and nature of the business activity is in total conflict with that of the immediate abutting properties as well as a detrimental impact on said properties, in terms of fire hazard, etc.
2. The applicant/owner has misled Council by supplying incorrect information when submitting the application, which is an offence in terms of Section 133(1)(e) of the Municipal Planning By-law, 2015.
3. The applicant has been operating from the property for a number of years but only submitted an application in 2016, after the Enforcement Section again served notice for unauthorized activity, despite being served in 2013.
