RESOLVED UNANIMOUSLY


a) The application for a temporary departure in terms of section 42(c) of the City of Cape Town Municipal Planning By-Law, 2015, in order to permit a clothing manufacturing factory to be operated from erf 34675, Mitchells Plain, BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions as set out in the attached Annexure A.

b) The application for a departure in terms of Section 42(b) of the City of Cape Town Municipal Planning By-Law, 2015 in order to permit 1 parking bay in lieu of 2 on Erf 34675 Mitchell’s Plain, BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015.


REASONS FOR DECISION:

1. The proposed activity is consistent with the guidelines and designation of the subject property in terms of the District Plan and relevant policy.
2. The activity will have a positive impact on local economy by creating a sustainable income for 6 – 20 persons.
3. The activity will create increased surveillance in the residential suburb during the day and will contribute to the safety in the area.
4. The proposed scale and nature of the business will not detract from the residential character of the area and the predominant use of the subject property will remain residential.
5. By limiting operating hours the welfare of the residents will be protected.
6. The BCO confirmed that the building is suitable for the business subject to the submission of building plans for the unauthorized building work which will address the fire and health regulations.
