RESOLVED UNANIMOUSLY
That an administrative penalty of 0% to the amount of R0 be imposed in terms of section 129 of the City of Cape Town Municipal Planning By-Law, 2015 for the unlawful structures in respect of Erf 974, 15 Piet My Vrou Street, Macassar, in accordance with plan no 974/029/2016 – Dated 2016/03/30.


REASONS FOR DECISIONS:

1. As the unlawful carport was constructed by the previous owner, the current owner (A. Pietersen) will not be held liable;
2. Although not responsible, the current owner acted in good faith and submitted the administrative penalty application and land use application to regularise the unlawful structure;
3. The structure is not contentious and has minimal impact.
