RESOLVED UNANIMOUSLY


That a 10% administrative penalty in the amount of R759.00 (rounded off) be imposed in terms of section 129 of the City of Cape Town Municipal Planning By-Law, 2015 for the unlawful building work (balcony) in respect of Erf 225, 200 Fagan street, Strand in accordance with plan no WD/1660 dated 23.05.16.

REASONS FOR DECISION:

1. The owner is fully responsible for the unlawful building work. Aerial imagery shows that the structures existed as of February 2015, thus making the duration of the contravention approximately 2 years.
2. The owner acted in good faith by submitting the necessary applications to rectify his transgression.
3. Due to owner having agreed to raise the screen wall to 1.8m high, the impact in terms of overlooking or intrusion of privacy will be limited.
