UNANIMOUSLY RESOLVED that:

a) The application for consolidation, as set out in Annexure A, of REM10861, REM10864, REM10865, REM10866, 10867, 10868, REM10878, REM10870, 10877, REM10869, 10863 and REM10862, bounded by Albert Road and Alexander, Davidson and Grey Street, Woodstock, BE APPROVED in terms of Section 98 of the City of Cape Town Municipal Planning Bylaw, subject to the conditions contained in the attached Annexure A.

b) The application for the approval of Council to permit

• building work within a Heritage Protection Overlay Zone;
• parking within less than 10.0m of the street at ground floor level and
• the building to be positioned at 0m in lieu of 5.0m from the PMR (Albert Road) street boundary

as contained in Annexure A attached in respect of REM10861, REM10864, REM10865, REM10866,10867, 10868, REM10878, REM10870, 10877, REM10869, 10863 and REM10862, bounded by Albert Road and Alexander, Davidson and Grey Street, Woodstock, BE APPROVED, in terms of Section 98 of the Municipal Planning By-Law subject to conditions contained in Annexure A attached.

c) The application for Council’s Consent for air rights over land zoned for Transport Zone 2: Public Road and Public Parking purposes, in respect of REM10861, REM10864, REM10865, REM10866,10867, 10868, REM10878, REM10870, 10877, REM10869, 10863 and REM10862, bounded by Albert Road and Alexander, Davidson and Grey Street, Woodstock, BE APPROVED in terms of section 98 of the Municipal Planning By-Law subject to conditions contained in Annexure A attached.


d) The application for departures from height, setbacks and floor factor in respect of REM10861, REM10864, REM10865, REM10866,10867, 10868, REM10878, REM10870, 10877, REM10869, 10863 and REM10862, bounded by Albert Road and Alexander, Davidson and Grey Street, Woodstock, BE APPROVED in terms of section 98 of the Municipal Planning By-Law subject to conditions contained in Annexure A attached.

CONDITIONS TO BE IMPOSED IN TERMS OF SECTION 100 OF THE
MUNICIPAL PLANNING BY-LAW
6.1 the portions of the building façade higher than 25m above the street level shall be setback a minimum of 1.5m (excluding balconies) from Albert Street to the satisfaction of the Director: Planning and Building Management
6.2 any structures such as balustrades and roof structures which are higher than 25m above street level and closer than 1.5m from the Albert Street boundary shall be designed to the satisfaction of the Director: Planning and Building Management
6.3 prior to final building plan submission, the refined aesthetic/architectural designs of the facades of the building shall be to the satisfaction of the Director: Planning and Building Management
6.4 the street level building façade shall be set back by at least 1.2m from the Grey Street and Alexander Street kerb lines to accommodate a pedestrian walkway.
6.5 The public realm improvements shown on the Landscaping Plan attached as Annexure F shall be implemented to the satisfaction of the Director: Planning and Building Management
6.6 Prior to building plan submission, the owner shall submit a letter from the Competent Authority (Western Cape Government: Road Infrastructure) which waives the 5.0m statutory building line along the PMR imposed in terms of Section 98(b) of the Municipal Planning By-Law 2015 of the Roads Ordinance


REASONS FOR DECISION:

1. The proposal complies with the criteria set out in section 99 of the Municipal Planning By-Law, 2015.
2. The proposal complies with the Cape Town Spatial Development Framework, Table Bay District Plan, Densification Policy and Urban Design Policy.
3. The proposal will conform to the mixed use nature and character of the area.
4. The proposal has active edges facing the street and no adverse impacts on the street environment are envisaged.
5. Intensification of the use of the property is appropriate considering the location thereof to Albert Road and the Woodstock train station.
6. The proposed increase in density is appropriate in the context of transport orientated development at a railway station.
7. The built form will not adversely impact on the area considering that conditions will require stepping of the building at upper levels to mitigate visual impacts of height.


8. The application was supported by various City departments and the comments of such departments have informed the imposition of suitable conditions to mitigate impacts of height on heritage resources and the built environment.
9. The service infrastructure has sufficient capacity to accommodate the proposal.
10. The property is located along a PT2 route where no parking is required, however on-site parking provision is desirable as it allows a range of transport options for the residential dwellers.
11. Access to the site will be taken from Grey Street, a lower order road and no adverse traffic impacts are envisaged as motivated in a Traffic impact Statement submitted with the application.
