UNANIMOUSLY RESOLVED that:
a. The application for the removal of the Restrictive Title Deed conditions C(5) and (6) contained in Title Deed T55850/2011 for Erf 59243, Lansdowne, IS APPROVED in terms of section 98(b) of the Municipal Planning By-Law, 2015.
b. The application for a regulation departure to accommodate the garage at 0.0m in lieu of 1.5m from the street boundary building line in respect of Erf 59243, Lansdowne, IS APPROVED in terms of section 98(b) of the Municipal Planning By-Law, 2015.
c. The application for a regulation departure to accommodate the permit the windows setback of 1.0m in lieu of 1.5m along the Southern common boundary building line IS APPROVED in terms of section 98(b) of the Municipal Planning By-Law,
REASONS FOR DECISION:
1. The proposal is regarded to be consistent with the Cape Town Spatial Development Framework and the Cape Flats District Plan as the property will be utilized for residential purposes and is therefore compatible with the surrounding built environment.
2. The impacts of the departures are considered to have limited impact on the neighbouring properties.
3. The decision making criteria relating to the Removal of Restrictive Title deed conditions as set out in paragraph 6.5 and 6.6 have been complied with.
4. The Restrictive Title Deed conditions are regarded as onerous as the DMS already adequately controls the development of the property.
