UNANIMOUSLY RESOLVED that:
a. The application for the relaxation of the restrictive title deed conditions, as set out in Annexure A, for Erf 85 Meadowridge, IS APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
b. The application for departures, as set out in Annexure A, for Erf 85 Meadowridge, IS APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION:
1. The architectural style of the proposed additions is compatible with the existing dwelling house.
2. The proposal will not have a negative impact on neighbouring property owners or on the character of the area.
3. The visual impact has been substantially improved since advertising by making the 2 halves of the garage appear to look somewhat different.
4. The very wide verge of Newton Drive significantly mitigates the impact.
5. The garage will replace an unsightly precast wall. The rest of the pre-cast wall along Newton Drive will also be replaced by a palisade wall/fence.
6. Garages close to the street boundary are not uncommon in the broader area.
7. No trees will be affected by the proposed. (This includes both street trees and trees on the property.
8. This proposal is consistent with the Southern District Plan and the Municipal Spatial Development Framework.
9. The proposal will not impact on any existing rights.
