Resolution details

UNANIMOUSLY RESOLVED that:

a. The application for consent in terms of item 55(b) of the Development Management Scheme to permit a restaurant on Erf 55343 Cape Town, IS APPROVED in terms of Section 98 of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

b. The application for departures, as set out in Annexure A for Erf 55343 Cape Town at Claremont IS APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

c. The application for the amendment of a condition of approval, as set out in Annexure A for Erf 55343 Cape Town at Claremont, IS APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION

1 The proposal will not negatively affect the character of the area or impact negatively on the neighbouring properties
2 Adequate parking is available in the area
3 The proposal results in an active street frontage that is positive for the area and creates very good surveillance over the public realm
4 The scale of the restaurant is small at only 61m2 in size, including outside area
5 Potential negative impacts can be controlled through conditions
6 Operating hours have been limited and these do not extend into the evenings
7 Noise will be controlled via the provincial Noise Control Regulations
8 Adequate municipal cleansing services are available
9 The proposal is consistent with the Southern District Plan and the Cape Town Spatial Development Framework
10 The proposal is aligned with the Economic Growth Strategy
11 The setback departures are technical in nature as the building exists and no building work is proposed
12 Conditions will ensure that the impact of the proposal is low
