b) The Municipal Planning Tribunal South-western Panel APPROVES the application for an administrative penalty in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 of R 850.00 for the unauthorised house shop operated at Erf 159416, Cape Town in accordance with plan for dwg drawn by R. DE Jong Designers dated January 2016.
REASONS FOR DECISION
1. The carport/garage is being used as a house shop in contravention of the Municipal Planning By-Law, 2015, however once the applicant was notified he submitted this application.
2. At the time of the site visit, the house shop was still operating.
The extent and gravity of the operation are both minor
