Resolution details

a) The Municipal Planning Tribunal South-western Panel APPROVES the application for consent for a freestanding base telecommunication station in terms of Item 99(b) of the Development Management Scheme, for Erf 54119 Cape Town at Claremont, in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to conditions as set out in Annexure A, attached to the departmental report dated 2016-10-21;

b) The Municipal Planning Tribunal South-western Panel APPROVES the application for a departure, as set out in Annexure A, attached to the departmental report dated 2016-10-21, for Erf 54119 Cape Town at Claremont, in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION:

1. The proposed freestanding base telecommunication station will not pose any proven negative impact on the surrounding population and environment. The base station will be more than 50m from any residential or business zoned property.
2. The visual impact of the mast can be addressed by means of a condition of approval.
3. The approval of this application does not impact on any existing rights and does not lack desirability.
4. The freestanding base telecommunication station will allow for co-location.
5. The property is located on the edge of the Claremont CBD in an area largely characterized by large, busy roads and a railway line.
6. The application complies with the requirements of the City’s Telecommunication Mast Infrastructure Policy.
