The Municipal Planning Tribunal South-western Panel APPROVES the application for amendment and deletion of restrictive conditions, as set out in Annexure A, attached to the departmental report dated 2016-10-18, for Erf 50134 Cape Town at Newlands, in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

b) The Municipal Planning Tribunal South-western Panel APPROVES the application for departures, as set out in Annexure A, attached to the departmental report dated 2016-10-18, for Erf 50134 Cape Town at Newlands, in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION:

1. The architectural style of the proposed additions is compatible with that of the existing dwelling house on the subject property and those in the surrounding area.
2. The proposal will not have a significant negative impact on neighbouring property owners.
3. The proposal will not alter the character of the area.
4. The proposal will not have a significant negative impact on the streetscape.
5. The proposal will not have a negative heritage impact.
6. The proposal will not have a negative transport impact.
7. The proposal will not have a negative socio-economic impact.
8. The proposal does not lack desirability.
9. The departures are mitigated by the wide street, the lightweight nature of the pergola and the modest height of the garage and pergola.
10. The street boundary building line departures only apply to a ±8-9m portion of the street boundary and not to the entirety of the street boundary, which has a length of 20.3m.
