Resolution details

a) The Municipal Planning Tribunal South-western Panel APPROVES the application for a departure, as set out in Annexure A, attached to the departmental report dated 2016-10-19, for Erf 2784 Constantia, in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION

1. The proposal is not inconsistent with the character of the area and will not have a negative impact on neighbouring properties.
2. The departure relates to only a small portion of the building.
3. The proposal will not impact on the streetscape as the property slopes downwards from Alphonse Close.
4. The Alphonse Close street boundary is very well vegetated.
5. The setback from the street will continue to be large (ie 4.2m).
6. The wide width of Alphonse Close (±13m) will mitigate the impact.
7. The proposal is desirable and does not impact on existing rights.
