a) The Municipal Planning Tribunal South-western Panel APPROVES the application for amendment of a restrictive condition, as set out in Annexure A, attached to the departmental report dated 2016-10-19, for Erf 8 Bishopscourt, in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
b) The Municipal Planning Tribunal South-western Panel APPROVES the application for a departure, as set out in Annexure A attached to the departmental report dated 2016-10-19, for Erf 8 Bishopscourt, in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION:
1. The architectural style of the proposed additions is compatible with that of the existing dwelling house on the subject property and those in the surrounding area.
2. The proposal will not alter the character of the area.
3. The proposal will not have a negative impact on neighbouring property owners.
4. The impact of the proposal is mitigated by the fact that the additions will be a considerable distance from any residential properties and will be screened by mature trees and dense vegetation on the subject property and the surrounding properties.
5. The proposal will not have a negative impact on the streetscape.
6. The proposal will not have a negative transport impact.
7. The proposal will not have a negative heritage impact.
8. The proposal will not have a negative socio-economic impact.
9. The proposal is desirable.
