RESOLVED TO RECOMMEND

That the lease of a Public Place, being Erf 31242 Bellville, situated at Van der Merwe Crescent, Blomvlei, shown hatched and lettered ABCDEF on Plan 130008766 marked Annexure A, in extent approximately 787m², to Ivan Mendelsohn, owner of Erf 1637 Bellville or his successor in title, BE APPROVED subject, to inter alia the following conditions, that:

A tariff rental of R3 540.87 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;

The lease will endure for a period of 10 years;

The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;

The property be used for gardening and security purposes only;

The applicant may not remove any trees without the written approval from the Director: Recreation and Parks;

Trees, once planted on Council owned land, may not be removed or pruned without prior consultation with and written approval from the Director: Recreation and Parks;

No development of any permanent or temporary structures are permitted within the leased area;

Subject to such further conditions imposed by the Director: Property Management in terms of her delegated authority;

Subject to compliance with any other statutory requirements;

No compensation will be payable for any improvement made to the property;

The objections not be upheld.
