Resolution detail

It was RESOLVED that

(a)          the application for extension of liquor trading hours in respect of Bonteheuwel Liquorshop, 20A Firethorn Street, Bonteheuwel BE REFUSED for the following reason(s), based on the comment received from the City’s Town Development Management Department:

(i)            The property is zoned General Residential 4 (GR4) and the sale of liquor is not permitted as a land use right;
(ii)          The application for temporary departure submitted to Development Management in terms of Section 42(c) of the Municipal Planning By-Law, 2015, as amended, was refused on 7 February 2023

(b)          The applicant be informed that considering the existing operation of a liquor outlet without valid land use approvals is deemed unlawful and is subject to an application for determination of an administrative penalty in terms of Section 42(r) of the Municipal Planning By-Law, 2015, as amended;
 
(c)          The applicant be informed of the right to appeal the outcome of the application.
