It is recommended that the lease of a public place being Erf 1719 Montague Gardens and a portion of public street being a portion of remainder of Erf 1618 Montague Gardens, situated at Graph Avenue, Montague Gardens shown hatched and lettered ABCDEF & GHJK, on Plan No TA 953v2 attached and marked annexure A, in extent approximately 214m² and 31m² respectively, to Redefine Property Limited or its successors in title, be approved subject to inter alia the following conditions;
A) A market rental of R 4 125 per month excluding VAT and including rates calculated at the rate applicable at the time of transaction be payable;
B) Beneficial occupation of R4 125, escalated at 6% per annum, be charged as from 2019-11-01 until 2022-08-11;
C) The proposed lease term is for a period of 10 years and is to be reviewed after a period of 5 years;
D) The property be used for parking and security purposes only;
E) No permanent structures are permitted;
F) No structures of any kind are to be erected over the existing sewer and water mains;
G) Access for maintenance and inspection must be granted at all times;
H) The area where the services are situated can only be used for light gardening to avoid any damages to the sewer line;
I) No compensation will be payable for any improvements made to the property, with or without the consent of the Council, should the lease be terminated for any reason whatsoever.
