RESOLVED by 3 votes to 1 that:
a. The application for the deletion of restrictive title deed conditions as contained in Annexure A attached in respect of Erf 858, Sea Point East BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

b. The application for Permanent Departures as set out in Annexure A, relating to the boundary wall, in respect of Erf 858, Sea Point East BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015.

c. The application for Permanent Departures as set out in Annexure A, relating to the street boundary building line, in respect of Erf 858, Sea Point East BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015.

d. The application for Permanent Departures as set out in Annexure A, relating to the height of the building line within the common building line, in respect of Erf 858, Sea Point East BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015.


REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to the following changes:

Amend reason 6.1.1 as follows:
6.1.1 The deletion of the title deed conditions will enable the intensification of the use of the property and ensure improved utilisation of the property.

Amend reason 6.1.9 as follows:
6.1.9 The deletion and amendment of the title deed condition is in line with the land use planning principles of efficiency and spatial sustainability as set out in the SPLUMA and LUPA, in that the development promotes intensification of land uses with the constraints of existing infrastructure, without detracting from the visual or residential appeal of the area are fostered.
