Resolution details

UNANIMOUSLY RESOLVED that:
a. The application for consent to permit a house shop on erf 3443, Montague Gardens (Summer Greens) BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 (as amended), subject to the conditions set out in Annexure A;

b. The departure to permit the encroachment of the 1.5m street building line to 0m for a covered patio on erf 3443, Montague Gardens (Summer Greens) BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 (as amended), subject to the conditions set out in Annexure A;

c. The departure to permit a second dwelling and covered patio (porch) to exceed the permitted coverage from 75% to 83% on erf 3443, Montague Gardens (Summer Greens) BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 (as amended), subject to the conditions set out in Annexure A; and

d. The departure to permit a second dwelling to be constructed in an architectural style dissimilar from the main dwelling house on erf 3443, Montague Gardens (Summer Greens) BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 (as amended), subject to the conditions set out in Annexure A.

Recommendation 9.1 is not required and therefore deleted

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reason 7.1.5 as follows:

7.1.5 The proposed second dwelling design, coverage and building line departures have received support from the relevant City service departments and is considered to be compatible in the existing residential setting which is not devoid of similarly placed and designed structures.

Annexure A:
Amend condition 1.1 to read as follows:
1.1 Consent use in terms of Item 21(c) of the Development Management Scheme to permit a 40m2 shop
