UNANIMOUSLY RESOLVED to RECOMMEND that the lease public place being of Erf 2027 Hout Bay, situated at Llandudno Road, shown hatched and lettered ABCDEFGHJ on the LT116v2 marked annexure A, attached to the report, in extent approximately 9113 m², to Llandudno Sports Club, or its successors in title, BE APPROVED subject to inter alia the following conditions, that:
a)A tariff rental of R883.48 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;
b)The lease will endure for a period of ten years, with an option to renew for a further ten years;
c)The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
d)The property be used for Sports Club purposes only and no structures other than the existing structures including the play park will be permitted in the lease area;
e)Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
f)Subject to compliance with any other statutory requirements;
g)No compensation will be payable for any improvement made to the property;
h)Electricity services exist within the lease area but any alternations or deviation to the electricity services necessary as a consequence of the proposal,
or requested by the applicant will be carried out at the applicant’s cost;
i)City of Cape Town has the right to construct and/ or erect and lay such poles, stays, cables, wires or appurtenances relating thereto as may be necessary, together with the right to use, inspect, maintain, repair, alter, relay and /or remove all such poles, stays, cables, wires or appurtenances aforesaid.
j)This includes the right to bring machinery onto the property and to carry out excavations;
k)The City of Cape town has the right for any employee or contractor for the City of Cape Town to enter and upon the property at any time in the exercise of the aforementioned rights;
l)No building containers or structures shall be erected within 3m of the electrical services;
m)No excavation or filling shall be carried out within the leased area without the prior written consent of the Director: Electricity Services via the way-leave approval process. All excavations within 3m of the electrical services must be carried out under the direction of the representative of the Department. In this regard please contact this Directorate two weeks before the commencement of work;
n)No stakes, pegs or pins shall be driven into the ground within 1m of any part of electricity services;
o)No plant material shall be stored within 1m of any part of electricity services;
p)No mechanical plant may be used within 3m of medium voltage cable or 5m of high voltage cable;
q)Perimeter enclosure and access must conform to the requirements and specifications of this department, allowing 24-hour unrestricted access;
r)Telkom services are known to exist within the lease area and it is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which may not be indicated on the plan;
s)Telkom requires access to carry out maintenance or upgrade existing plants at all times;
t)No structure to be constructed or placed within 3m from the storm water service line;
u)A sewer crosses the area in question (the approximate position is shown on Plan LT 1161v2) and no excavations filling shall be carried out within the area without consent of Council;
v)The Council shall have the right of access at all times for the purposes of maintaining and repairing the sewer;
w)The area is affected by a sewer that traverses the affected area parallel to the south boundary. The sewer shall remain exposed for inspection purposes and maintenance at all times;
x)Further recommendations from “ Fire Services” are attached to the report as annexure “C”.
