Resolution details

RESOLVED UNANIMOUSLY that:

a. An administrative penalty in the amount of R0 BE DETERMINED in terms of section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 97535 Cape Town at Newlands regarding the unauthorised building work relating to the carport as shown on the plan drawn by Rozowsky Associates with drawing number S6651, Revision 1F, dated 15/02/2021.

b. An administrative penalty in the amount of R2 000.00 BE DETERMINED in terms of section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 97535 Cape Town at Newlands regarding the unauthorised building work relating to the dwelling house extensions / alterations as shown on the plan drawn by Rozowsky Associates with drawing number S6651, Revision 1F, dated 15/02/2021.

REASONS FOR DECISION

The MPT APPROVED the application for the reasons set out in the Planner’s report, except reason 6.8 which is deleted and amended reason 6.6 as follows:

6.6 The current owners / applicant supplied inaccurate information to the City in contravention of Section 78 of the Municipal Planning By-Law: no new additional unauthorised building work was done after the previous penalty was paid and this warrants the reduction in the penalty amount.
