Resolution details

UNANIMOUSLY RESOLVED that:
a. The application for Permanent Departures as set out in Annexure A below in respect of Erf 142717 Cape Town, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.

b. The application for Council’s Consent as set out in Annexure A below in respect of Erf 142717 Cape Town, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.

c. The application for City Approval as set out in Annexure A below in respect of Erf 142717 Cape Town, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION
The MPT REFUSED the application for the reasons set out in the Planner’s Report and agreed to amend reasons

7.1.1 The proposal and applications do not comply with the requirements set out in Section 99(1)C of the Municipal Planning By-Law, 2015.

7.1.2 The applications are not desirable in terms of Section 99(3) of the Municipal Planning By-Law, 2015 as argued in the case officer’s report

7.1.4 The proposal will have a materially negative impact on the heritage status of the surrounding area – insufficient information was provided on the heritage impact of the proposed development
