Ref 70597741 - Removal of title deed restriction, subdivision, rezoning, City approval, and permanent departures<span> <h2 class="sectHeading">​​​​​​​​​​App​lication details​​​​​​​​</h2></span> <p>District office: <a href="" target="_blank">Table Bay District</a><br> Application number: 70597741<br> Applicant / owner details: Terraplan Town and Regional Planners/ City of Cape Town.<br> Description and physical address: New Market Street, Cape Town.<br> Submission period: 8 July - 17 August 2022</p><h2 class="sectHeading">​​​​​​​​​​Purpose of the application​​​​​​</h2><p>A social housing/mixed use development on a portion of remainder erf 14888, Cape Town known as the New Market Street affordable housing development. </p><p> The proposed development is to comprise of medium density multi-storey buildings set around several courtyard areas, accommodating retail and social and market apartments. A parking area would be created as part of a court yard area between, and inside, the development buildings on one basement and two semi-basement levels. </p><p> The following applications are required in terms of the MPBL in order to achieve the proposed development.</p><ol><li>1. <strong>Subdivision </strong>of a portion of erf 14888, in terms of Section 42(d) of the MPBL, 2019, to formalize the relevant portion to be developed. </li><li> 2. <strong>Closure of Public Street</strong> for the portion of erf 14888 to be closed and rezoned to Mixed Use (MU3) in terms of Section 42(i) of the CCT MPBL, 2019. </li><li> 3. <strong>Rezoning</strong> of a portion of erf 14888, Cape Town, from Transport Zone (TR2) to Mixed Use (MU3), in terms of Section 42(a) of the MPBL, 2019. </li><li> 4. <strong>Consent use/City’s approval</strong> to allow development within the Heritage Protection Overlay Zone (HPOZ) in terms of Section 42(i) of the CCT MPBL, 2019 as provided for in terms of Section 162(b)(iii). </li><li>5. <strong>Removal of a restrictive title deed condition</strong> in terms of Section 42(g) of the MPBL, 2015, through removal of Condition C: ……. The land shall be used for roads, parks and gardens only and for no other purpose save with the written consent of the South African Transport Services, with full power and authority henceforth to possess the same in perpetuity, the State however reserving its rights. </li><li> 6. <strong>Parking departure</strong> in terms of Section 42(b) to allow substandard parking for the apartments and Social Housing.
