Ref 70560332 - Consent, rezoning, subdivision, registration of servitudes, departures and naming of internal private street<span> <h2 class="sectHeading">​​​​​​​​​​App​lication details​​​​​​​​</h2></span> <p>District office: <a href="" target="_blank">Helderberg District</a><br> Application number: 70560332<br> Applicant / owner details: Messrs Headland Planners (Pty) Ltd / Messrs Nation Housing Pty Ltd.<br> Description and physical address: 57 Kirkia Street, Heldervue, Somerset West.<br> Submission period: 29 October - 3 December 2021</p><h2 class="sectHeading">​​​​​​​​​​Purpose of the application​​​​​​</h2><ol><li>a) Consent in terms of restrictive title deed conditions B.1, B.2, B.3 and B.4 registered in Title Deed T42009/2020 in order to allow Erf 4095, Somerset West to be subdivided, to allow more than one dwelling, to allow a change in use of the property and to omit the restrictions relating to buildings lines. </li><li>b) Rezoning of Erf 4095, Somerset West from Agricultural Zone to Subdivisional Area (underlying rights for 43 Single Residential (SR1) zoned portions, 10 (SR1) portions (refuse room, private open space, private road, electrical kiosk) and one Utility Zone portion (mini substation)). </li><li>c) Subdivision of Erf 4095, Somerset West into 54 portions. </li><li>d) Register private electrical services servitudes over portions 8, 23 and 24. </li><li>e) Exempt the following servitude registrations from the need for approval:</li></ol><ul><li>a 5 m Municipal services servitude to be registered over portions 7,8,16 and 50 – 52; and </li><li>two servitude rights of way over portions 8 in favour of portions 7 and over portion 23 in favour of portions 24.</li></ul><ol><li>f) Permanent departures for the following:</li></ol><ul><li>Item 22(a) to permit Erf 34 to have a floor factor of 1,06 in lieu of 1,0. </li><li>Item 22(c)(ii) for blanket departures from this provision where buildings are permitted within the 3 m common building line and are more than 4 m in height.
