Ref 70558120 - Removal and amendment of title deed restrictions and of conditions in respect of an existing approval granted or deemed to be granted<span> <h2 class="sectHeading">​​​​​​​​​​App​lication details​​​​​​​​</h2></span> <p>District office: <a href="http://resource.capetown.gov.za/documentcentre/Documents/Forms%2c%20notices%2c%20tariffs%20and%20lists/TDA%20DM%20-%20Contacts.pdf" target="_blank">Table Bay District</a><br> Application number: 70558120<br> Applicant / owner details: Andrew Pratt Town Planning/ Alexander Neubronner.<br> Description and physical address: 17 Oudekraal Road, Camps Bay.<br> Submission period: 17 September - 27 October 2021</p><h2 class="sectHeading">​​​​​​​​​​Purpose of the application​​​​​​</h2><p>It is the intention to demolish the existing dwelling house on the property and to erect a new building containing two dwelling houses. </p><p>Provision is made for basement parking accommodating six vehicles. </p><p>In order to undertake the proposed development, amendment of conditions of title and approval relating to the number of dwellings and “built-upon” area, as well as deletion of a condition relating to street, rear and lateral boundary setbacks and minor departures relating to common boundary and street building lines are required.</p><p>Application is made for the amendment of restrictive title deed in terms of Section 42 (g) and amendment of a condition deemed to have been imposed in terms of the MPBL in terms of Section 42(j) of the MPBL, in order to regularise the retaining structures, access stairs and practice wall. </p><ul><li>1. Amendment of the following conditions of title and conditions of approval imposed by the Administrator in terms of Ordinance No 33 of 1934, in terms of Section 42(g) and 42 (j) of the MPBL (new wording underlined/ old wording scratched out): </li><li> 1.1 Title deed T40775/2018, condition E.5. (b) which reads as follows: <em>“it shall be used only for the purpose of erecting thereon one dwelling, together with such outbuildings as are ordinarily required to be used therewith”</em> <br> - To read as follows: <em>“it shall be used only for the purpose of erecting thereon two dwelling, together with such outbuildings as are ordinarily required to be used therewith”</em> </li><li> 1.2 Title deed T40775/2018, condition E.5. (c) which reads as follows: <em>“not more than half the area thereof shall be built upon”</em> <br> - To read as follows: <em>“not more than 63% of area thereof shall be built upon”</em> </li><li> 2. Deletion of the following condition of title and approval imposed by the Administrator in terms of Ordinance No 33 of 1934, in terms of Section 42(g) and 42 (j) of the MPBL </li><li> 2.1 Title deed T40775/2018, condition E.5.(d) which reads as follows: <em>“no building, or structure, or any portion thereof, except boundary walls and fences shall be erected nearer than 7,87 metres to the street line which forms a boundary to this erf, nor within 3,15 metres of the rear or 1,57 metres of the lateral boundary common to any adjoining erf, provided that with the consent of the Local Authority an outbuilding not exceeding 3,05 metres in height measured from the floor to the wall plate, may be erected within the above prescribed lateral space for a distance of 9,45 metres from the rear boundary. On consolidation of any two or more erven this condition shall apply to the consolidated area as one erf.”</em> </li><li> 3.
