28 June 2021</p><h2 class="sectHeading">​​​​​​​​​​Purpose of the application​​​​​​</h2><ol><li>i) In terms of Section 42(f) of the City of Cape Town Municipal Planning By-Law, 2015 for the consolidation of Remainder Farm 420 Stellenbosch, Portions 80, 114 and 115 of the farm Saxenburg 419, Remainder of Portion 3 of the Farm Sandown 1053 and a portion of Portion 33 of the farm Langverwacht 238, Division Stellenbosch. </li><li> ii) In terms of Section 42(a) of the City of Cape Town Municipal Planning By- Law, 2015 for the rezoning of the consolidated property in (i) from Agricultural Zone to Subdivisional Area Overlay Zoning (General Residential Zone 1, General Residential 2, Utility Zone (Electrical Substations), Open Space Zone 2 (Public Open Space), Open Space Zone 3 (Private Open Space) and the remainder Transport Zone 2 (Public Road). </li><li> iii) In terms of Section 42(d) of the City of Cape Town Municipal Planning By-Law, 2015 for the subdivision of the consolidated property to create the following:</li></ol><ul><li>47 erven zoned as General Residential Zone 1 (GR1) to be developed as group housing; </li><li>3 erven zoned as General Residential Zone 2 (GR2) to be developed as Apartments (318 Flat units); </li><li>2 erven to be zoned as Utility Zone to accommodate electrical substations; </li><li>1 erf to be zoned Open Space Zone 3 (Private Open Space) being private road and private open space; </li><li>remainder of the property to be zoned Transport Zone 2 (TR2) and Open Space Zone 2 (Public Open Space) for public roads and open spaces.</li></ul><ol><li>iv) In terms of Section 42(i) of the City of Cape Town Municipal Planning By- Law, 2015 for consent use to permit a utility service (detention pond) on the portion zoned as Private Open Space and to also permit a Place of Instruction on the proposed Portion 1 (General Residential Zone 2 erf). </li><li> v) Approval of the proposed site development (with construction phasing) and landscaping plans for the respective General Residential erven prepared by JvZ Architects, in terms of Section 42(i) of the City of Cape Town Municipal Planning By-Law, 2015. </li><li> vi) In terms of Section 42(e) of the City of Cape Town Municipal Planning By-Law, 2015 to allow for a phased development.</li><li>vii) In terms of Section 42(b) City of Cape Town Municipal Planning By-Law, 2015 for regulation departures to relax the 4,5m building lines pertaining to erven zoned as General Residential 2 to 0m insofar as it has bearing on proposed shade ports.</li></ol> <span> <h2 class="sectHeading">​​​​​​​​​​Submit your comments​​​​​​​</h2></span> <p>Submit your comments, objections and representations by <a href="mailto:comments_objections.tygerberg@capetown.gov.za?subject=Comment%20on%20application-ref%2070546367">email</a>.<br><br> All submissions need to include the following:</p><ul><li>​The application reference number.</li><li>The details of the person submitting the comment or objection, including the full name, interest in the application, address, contact details and the method by which they can be contacted.</li><li>The reason for the objection, including the effect that the application will have on a person/area and any aspect of the application that you consider inconsistent with policy, and how.</li></ul><p>​Submissions in writing need to be made to the specified <a href="http://resource.capetown.gov.za/documentcentre/Documents/Forms%2c%20notices%2c%20tariffs%20and%20lists/TDA%20DM%20-%20Contacts.pdf" target="_blank">district office</a> on or before the closing date.<br><br>View our <a href="http://www.capetown.gov.za/City-Connect/Claim-or-dispute/Object-to-an-application/Object-to-a-land-use-application">guidelines on submitting objections / comments on land use applications, or to make oral submissions​</a>.</p> <span> <h2 class="sectHeading">​​​​​​​​​​General conditions​​​​​​​</h2></span> <ul><li>An objection, comment or representation that does not meet the requirements above may be disregarded.</li><li>Late comments or objections will not be considered unless the City Manager has agreed in writing.</li><li>If you are unable to write, you may come to the specified <a href="http://resource.capetown.gov.za/documentcentre/Documents/Forms%2c%20notices%2c%20tariffs%20and%20lists/TDA%20DM%20-%20Contacts.pdf" target="_blank">district office</a> during office hours where you will be assisted with transcribing your comment or objection and associated reasons.​<br></li></ul>GP0|#03e6040c-6cd2-4a39-bb7a-22f89a0c8c01;L0|#003e6040c-6cd2-4a39-bb7a-22f89a0c8c01|Land use applications;GTSet|#a7cfb90d-44ad-4426-98ce-565f79932396;GPP|#79e6adda-2aa2-4523-bc29-296828216c9328 May -
