The amendment of restrictive condition No. 6.A.I(b) in Title Deed T57867/2013 in terms of Section 42(g) of the MPBL (2015), to read as follows: <br><br><em>“That only one or two dwellings, together with such outbuildings as are ordinarily required to be used therewith be erected on this erf save as provided in condition (c) hereof”. </em></li><li>2. The deletion of restrictive conditions No. 6.A.I(d), (e), (f) and No. 6.B.2 in Title Deed T57867/2013 in terms of Section 42(g) of the MPBL (2015). </li><li>3. The amendment and deletion of Township conditions of planning approval imposed by the Administrator in terms of Ordinance 33 or 1934 [relating to the above restrictive Title Deed Conditions No. 6.A.I(b), (d), (e) and (f)] in terms of Section 42(j) of the MPBL (2015). </li><li>4. The following regulation departures are required as a result of the proposal: </li><li>4.1 Section 22(c)(ii) of the <a href="http://www.capetown.gov.za/work%20and%20business/planning-portal/regulations-and-legislations/the-city-of-cape-towns-development-management-scheme">Development Management Scheme (DMS)</a> – A permanent departure to permit the proposed additions and alterations within the respective 3,0 m northern and southern common boundaries (beyond the 1st 12 m from the street boundary) to be approximately 6,33 m high (northern) and 6,95 m high (southern) from the existing ground level to top of roof in lieu of 4,0 m in terms of Section 42(b) of the MPBL (2015). </li><li>4.2 Section 22(d) of the DMS – A permanent departure to permit a new pottery room extension, balcony, guest bedroom and internal garage entrance with a new roof structure to be 0,0 m in lieu of 3,0 m from the southern common boundary in terms of Section 42(b) of the MPBL (2015). </li><li>4.3 Section 22(d) of the DMS – A permanent departure to permit new bedrooms and a bathroom with a new roof structure to be 1,9 m and new retaining walls to be 0,0 m in lieu of 3,0 m from the northern common boundary in terms of Section 42(b) of the MPBL (2015). </li><li>4.4 Section 22(f)(i)(aa) of the DMS - A permanent departure to permit the proposed new garage on the southern common boundary to be approximately 5,17 m high from the existing ground level to top of roof in lieu of 3,5 m in terms of Section 42(b) of the MPBL (2015). </li><li>4.5 Section 22(f)(iii) of the DMS - A permanent departure to permit the proposed new garage 0,0 m in lieu of 5,0 m from the street boundary in terms of Section 42(b) of the MPBL (2015). </li><li>5.
