Ref 70532139 - Rezoning, subdivision, approval, consolidation, permanent departures, removal of restrictive conditions, deletion of approval condition and certification of the HOA constitution<span> <h2 class="sectHeading">​​​​​​​​​​App​lication details​​​​​​​​</h2></span> <p>District office: <a href="https://resource.capetown.gov.za/documentcentre/Documents/Forms%2c%20notices%2c%20tariffs%20and%20lists/TDA%20DM%20-%20Contacts.pdf" target="_blank">Northern District</a><br> Application number: 70532139<br> Applicant / owner details: H Du Plooy /R Van Rooyen.<br> Description and physical address: 1 Boland Way and 54 Jagger Street, Durbanville.<br> Submission period: 12 February - 22 March 2021</p><h2 class="sectHeading">​​​​​​​​​​Purpose of the application​​​​​​</h2><p>Application in terms of Section 42(a) of the MPBL, 2015 for the rezoning of Erven 1723 and 1724, Durbanville from Single Residential Zoning (SR1) to Subdivisional Area Overlay Zoning.</p><p>Application in terms of Section 42(d) of the MPBL, 2015 for the subdivision of Erven 1723 and 1724, Durbanville to permit:</p><ul><li>38 portions zoned General Residential Zoning (GR1) (Portions 1-38) </li><li>One portion zoned General Residential Zoning (GR2) (Portion 39) </li><li>Four portions zoned Open Space Zoning  (OS3) (Portions 40-43)</li></ul><p>Application in terms of Section 42(e) of the MPBL, 2015 for the implementation of a subdivision approval in phases </p><p>Application in terms of Section 42(f) of the MPBL, 2015 for the consolidation of Erven 1723 and 1724, Durbanville </p><p>Application in terms of Section 42(b) of the MPBL, 2015 for the following permanent departures on Erven 1723 and 1724, Durbanville:</p><h4>In respect of Portion 39 [zoned General Residential Zoning (GR2)]:</h4><ul><li>Section 41(e): A relaxation of the eastern common boundary building line of Portion 39 adjacent Erf 430 to be 1,1 m in lieu of 4,5 m.</li><li>Section 41(e): A relaxation of the western common boundary building line of Portion 39 adjacent Portions 2 to 4 to be 1,5 m in lieu of 5,2 m.</li></ul><h4>In respect of the Group Housing Site [(zoned General Residential Zoning (GR1)]:</h4><ul><li>Section 35(b): The maximum gross density on the group housing site to be 47 dwelling units per hectare in lieu of 35 dwelling units per hectare.</li><li>Section 35(e): A relaxation of the street boundary building line adjacent Jagger Street for a gatehouse of 5,5 m² to be 0,3 m in lieu of 5 m.</li><li>Section 35(e): A relaxation of the eastern common boundary building lines of Portions 2 to 4 adjacent Portion 39 to be 2,5 m in lieu of 3 m.</li><li>Section 35(e): A relaxation of the southern common boundary building line of Portion 4 adjacent Portion 39 to be 0 m in lieu of 3 m.</li><li>Section 35(f): The garage doors facing the internal road to be set back as follows from the kerb of such internal road:<br>- Portions 2, 3 and 4: 3 m in lieu of 5 m. <br> - Portion 14: 4,5 m in lieu of 5 m.<br> - Portion 15: 4,2 m in lieu of 5 m.<br> - Portions 17 and 18: 4,7 m in lieu of 5 m.<br> - Portion 19: 0 m in lieu of 5 m.<br> - Portion 33: 2,9 m and 3,5 m respectively in lieu of 5 m.</li></ul><h4>General:</h4><ul><li>Section 136B(f): The street boundary wall located within 4,5 metres of the intersection of Boland Way and Welling Street boundaries enclosing an angle of less than 135 degrees to be solid with only the splay portion of the wall to be visually permeable.</li><li>Section 136B(g): The boundary walls that face the adjacent public streets (Wellington Street and Boland Way) to be permeable 19% in lieu of 25 % of the total vertical area of the boundary wall, excluding any garage doors or visually permeable gates.</li></ul><p>Application in terms of Section 42(i) of the MPBL, 2015, as provided for by Item 123 of the City of Cape Town <a href="https://www.capetown.gov.za/work%20and%20business/planning-portal/regulations-and-legislations/the-city-of-cape-towns-development-management-scheme">Development Management Scheme</a>, for the approval of the Site Development Plan (SDP) and Landscaping Plan (LP)</p><p>Application in terms of Section 42(i), read with the provisions of Section 136 of the MPBL, 2015 for the approval of the proposed street name Autumn Wood Street including street numbers</p><p>Application in terms of Section 42(g) of the MPBL, 2015 for the removal of the following restrictive conditions:</p><ul><li>Par. D(c) of title deed T52057/2019 with respect to Erf 1723, Durbanville regarding building setbacks only.</li><li>Par.
