Ref 70524013 - Removal of title deed conditions, rezoning, consolidation and departures<span> <h2 class="sectHeading">​​​​​​​​​​App​lication details​​​​​​​​</h2></span> <p>District office: <a href="http://resource.capetown.gov.za/documentcentre/Documents/Forms%2c%20notices%2c%20tariffs%20and%20lists/TDA%20DM%20-%20Contacts.pdf" target="_blank">Table Bay District</a><br>Application number: 70524013<br> Applicant / owner details: Tommy Brummer Town Planner<br> Description and physical address: 35 and 37 Victoria Road, Clifton.<br> Submission period: 21 May - 30 June 2021</p><h2 class="sectHeading">​​​​​​​​​​Purpose of the application​​​​​​</h2><p>Proposed block of flats containing nine dwelling units and 25 parking bays (six storeys and two basement levels) requiring the following applications:</p><ol> <li> <strong>1. Title Deed Conditions </strong><br><br><strong>The following conditions needs to be deleted in terms of Section 42(g) of the By-Law:</strong> </li><li>1.1 With regard to Erf 563 (Deed of Transfer T55220/2016): <br><br>(1)C.1 That a space not less than 15 feet in width be left in front of all lots fronting or abutting Victoria Road, such space may be utilised as gardens or forecourts.<br> <br>(1)C.2: That not more than one building be erected on any one lot and coverage shall not exceed 50%.<br> <br>(2)B.1. That a space not less than 4,72 metres be left in front of all lots fronting or abutting Victoria Road, such space may be utilised as gardens or forecourts.<br> <br>(2)B.2. That not more than one building be erected on any one lot and coverage shall not exceed 50%. </li><li><strong>1.2 With regard to Erf 83 (Deed of Transfer T31021/2015):</strong> <br>B.1 That a space not less than 4,72 metres in width be left in front of all lots fronting or abutting Kloof Road and Victoria Road. Such space may be utilised as gardens or forecourts.<br> <br>B.2: That not more than one building be erected on any one lot, and that not more than half the area of any one lot be occupied by buildings.” </li><li><strong>2. Consolidation</strong> <br>In terms of Section 42(f) of the By-Law application is made for the consolidation of Erven 83 and 563 Clifton to measure 949 m² in extent. </li><li><strong>3. Rezoning </strong><br>In terms of Section 42(a) of the By-Law, application is made for the rezoning of Erven 83 and 563 Clifton from General Residential Sub-zoning (GR4) to General Residential Sub-zoning (GR5). </li><li><strong>4. <a href="http://www.capetown.gov.za/work%20and%20business/planning-portal/regulations-and-legislations/the-city-of-cape-towns-development-management-scheme">Development Management Scheme (DMS) </a></strong><br>In terms of <strong>Section 42(b)</strong> of the By-Law application is made for the following departures from the provisions of the DMS: </li><li>4.1 From Item 41(a), to permit the proposed coverage to be 88% in lieu of a coverage of 60% permitted. </li><li>4.2 From Item 41(e), to permit the following building line setbacks from the erf boundaries: </li><li>4.2.1 From the <strong>east (rear) common boundary</strong>, the building at:</li></ol><ul><li>0 m in lieu of 4,5 m (ground floor/first storey) </li><li>0 m in lieu of 4,5 m (first floor/second storey) </li><li>0 m in lieu of 6,333 m (second floor/third storey) </li><li>0 m in lieu of 8,763 m (third floor/fourth storey) </li><li>0 m in lieu of 11,583 m (fourth floor/fifth storey).</li></ul><ol><li>4.2.2 From the <strong>north common boundary</strong>, the building at:</li></ol><ul><li>0 m in lieu of 4,5 m (ground floor/first storey), beyond 18 m from the street, </li><li>0 m in lieu of 4,5 m (first floor/second storey), beyond 18 m from the street, </li><li>0 m in lieu of 6,333 m (second floor/third storey), beyond 18 m from the street, </li><li>0 m in lieu of 8,763 m (third floor/fourth storey), beyond 18 m from the street, </li><li>0 m in lieu of 11,583 m, within and beyond 18 m from the street, (fourth floor/fifth storey).</li></ul><ol><li>4.2.3 From the <strong>south common boundary</strong>, the building at:</li></ol><ul><li>0 m in lieu of 4,5 m (ground floor/first storey), beyond 18 m from the street, </li><li>0 m in lieu of 4,5 m (first floor/second storey), beyond 18 m from the street, </li><li>0 m in lieu of 6,333 m (second floor/third storey), beyond 18 m from the street, </li><li>0 m in lieu of 8,763 m (third floor/fourth storey), beyond 18 m from the street, </li><li>0 m in lieu of 11,583 m, beyond 18 m from the street, and 1,495 m in lieu of 11,583 m, within 18 m from the street (fourth floor/fifth storey).</li></ul><ol><li>4.3 From Item 121(2), to permit the following portions of the building <strong>within 5 m of a designated metropolitan road (Victoria Road): </strong><br>- 1,370 m (planters), 2,975 m (security room), 3,295 m (external angled wall) and 4,64 m (building), in lieu of 5,0 m (Basement -3), <br>- 2,630 m (steel canopies) and 3.870m (building/external angled wall), in lieu of 5,0 m (Basement -2), <br>- 4,750 m (building) in lieu of 5,0 m (Basement -1). </li><li>4.4 From Item 172, to permit the building to be 28,605 m in height in lieu of 13 m in height above the street level of Victoria Road. </li></ol> <span> <h2
