Deletion of restrictive conditions in the title deeds of Erven 64295, 64296 and 64297 Cape Town at Kenilworth relating to “no subdivision”, “residential purposes only”, “one dwelling only”, 50% built upon area, street and lateral boundary building lines, no building or outbuilding permitted within 1,57 m of the existing sewer and access being granted to City Council for the maintenance, repair and renewal of the sewer. </li><li> 2. Deletion of conditions of an existing approval imposed in terms of the Township Ordinance No 33 of 1934 to “no subdivision”, “residential purposes only”, “one dwelling only”, 50% built upon area, and street and lateral boundary building lines. </li><li>3. To rezone the properties from Single Residential Zone (SR1) and Transport Zone (TR2) to Subdivisional Area Overlay Zone to allow for two portions zoned Transport Zone (TR2) (ie portions A and B) and one portion zoned General Residential Subzone (GR4) and Transport Zone (TR2) (ie the consolidated erf). </li><li> 4. To subdivide Erf 64296 into two portions (Portion A: ±7 m² and Remainder: ±758 m²). Portion A will be transferred to Council for road widening purposes. </li><li> 5. To subdivide Erf 64297 into two portions (Portion B: ±143 m² and Remainder: ±949 m²). Portion B will be transferred to Council for road widening purposes. </li><li> 6. To consolidate Erf 64295, Remainder Erf 64296 and Remainder Erf 64297. </li><li>7. The following departures from the <a href="http://www.capetown.gov.za/work%20and%20business/planning-portal/regulations-and-legislations/the-city-of-cape-towns-development-management-scheme">Development Management Scheme</a> have also been applied for: </li><li> (i) Item 22(d): To permit the existing dwelling house to be setback 0,7 m in lieu of 6 m from Braeside Road. </li><li> (ii) Item 41(a): To permit a coverage of 81% in lieu of 60% </li><li>(iii) Item 41(e): To permit the flats to be setback 0 m in lieu of 4,5 m Braeside Road. </li><li> (iv) Item 41(e): To permit the flats to be setback 3,72 m in lieu of 4,5 m Main Road. </li><li> (v) Item 41(e): To permit the flats to be setback 0 m in lieu of 4,5 m from the northern common boundary. </li><li> (vi) Item 41(e): To permit the flats to be setback 0 m in lieu of 4,5 m from the eastern common boundary. </li><li> (vii) Item 41(e): To permit the flats to be setback 4,5 m in lieu of 0.6 x height from the northern common boundary. </li><li> (viii) Item 41(e): To permit the flats to be setback 4,5 m in lieu of 0.6 x height from the eastern common boundary. </li><li> (ix) Item 45A: To permit vehicular access to the flats to be located on a portion of Braeside Road that has a width of 7,56 m in lieu of 9 m. </li><li> (x) Item 121(2): To permit the flats to be setback 3,72 m in lieu of 5m from Main Road (a designated metropolitan road). </li><li> (xi) Item 136B(a): To permit the street boundary wall along Braeside Road to be 2,41 m in lieu of 2 m above existing ground level. </li><li>(xii) Item 136B(a): To permit the street boundary wall along Main Road to be 2,39 m in lieu of 2 m above existing ground level. </li><li> (xiii) Item 136B(c): To permit the boundary wall of the eastern and northern common boundaries to be 3,4 m and 3,31 m respectively in lieu of 2,5 above existing ground level. </li><li> (xiv) Item 137: To permit eight visitors parking bays in lieu of 12.
