Submission period: 27 November - 8 February 2021</p><h2 class="sectHeading">Purpose of the application</h2><ul><li> It is proposed to convert the existing buildings on Erf 490 Bantry Bay into a dwelling house and second dwelling. The following applications are required to accommodate the proposal:
</li><li>In terms of Section 42(g) of the MPBL to remove Conditions E (2), E (3), F (2) F (3) from the following title deeds: T31342/1997 and T92859/2002).
</li><li>
In terms of Section 42(b) of the MPBL for the following permanent departures from:</li></ul><ol><li>Item 22(d) to permit the ground storey of the main dwelling house to be setback 2,371 m and 3,208 m in lieu of 3,5 m from De Wet Road.
</li><li>
Item 22(d) to permit the following setbacks from the common boundaries:
</li><li>1,416 m in lieu of 3 m from the South West Boundary (pergola on pool deck)
</li><li>0,25 m and 1,229 m in lieu of 3 m from the South West boundary (ground storey, main house)
</li><li>0,0 m in lieu of 3 m from the North East boundary (ground storey, main house)
</li><li>2,526 m in lieu of 3 m from the South West boundary (first storey, second dwelling)
</li><li>1,539 m and 2.638 m in lieu of 3 m from the South West boundary (ground storey, second dwelling)
</li><li>0,526 m in lieu of 3m from the North West boundary (ground storey, second dwelling)
</li><li>
From Item 22(c)(ii), to permit the pergola on the pool deck proposed within 3m from the south west common boundary, to be 7,052 m in lieu of 4 m above the base level.</li></ol><ul><li>In terms of Section 42(i) of the MPBL for City Approval in terms of Item 126 of the <a href="https://www.capetown.gov.za/work%20and%20business/planning-portal/regulations-and-legislations/the-city-of-cape-towns-development-management-scheme">Development Management Scheme (DMS)</a> to permit the ground floor of the second dwelling to be raised more than 1,5 m (up to 2,325 m) above the existing ground level.
