The existing dwelling house will be situated on Remainder Erf 700 while a new, smaller, single dwelling house will be constructed on the proposed Portion 1. The following applications have been applied for:</p><ol><li>1. <strong>Subdivision: </strong></li><li>1.1. To subdivide the property into two portions (Portion 1: approximately 320 m²; and Remainder Portion: approximately 1091 m²). </li><li> 2. <strong>To removal of title deed conditions out of Deed of Transfer T9853/1997: </strong></li><li>2.1. Condition E.1: “The above property shall not be subdivided into lots of a smaller area than 595 square metres.” </li><li> 2.2. Condition E.2: “No more than one house shall be built on each lot and no dwelling house to be built shall be inconsistent with the environment.” </li><li>2.3. Condition F.1: “That no lots shall have a frontage of less than 18,89 metres and that they be used for residential purposes only.” </li><li> 2.4. Condition F.2: “That a space of not less than 4,72 metres in width be left in front of all lots fronting or abutting on the High Level Road, 15,74 metres, and the roadway marked thoroughfare. That a space of not less than 3,15 metres in width be left in front of all lots fronting or abutting on any of the three roads, 12,59 metres. Such space may be utilised as gardens or forecourts.” </li><li>2.5. Condition F.3: “That not more than one dwelling be erected on any one lot without the written consent of the Council of the City of Cape Town, and that no more than one-third of the area of any one lot be built upon.” </li><li> 3. <strong>Departures: </strong><br>Portion 1 </li><li>3.1. Item 22(c)(ii): To permit portions of the proposed building within 12 m from the street boundary and setback from the western common boundary to 4,75 m and 6,51 m in height from the base level to the top of roof in lieu of 4 m in height from the base level to the top of roof. </li><li>3.2. Item 22(c)(ii): To permit portions of the proposed building beyond 12 m from the street boundary and within 3 m of the common boundaries to 6,355 m and 7,86 m in height from the base level to the top of roof in lieu of 4 m in height from the base level to the top of roof. </li><li>3.3. Item 22(d): To permit portions of the proposed dwelling, beyond 12 m from the street boundary, to be 0 m in lieu of 3 m from the south-eastern common boundary. </li><li>3.4. Item 22(d): To permit portions of the proposed dwelling to be 2,566 m and 2,917 m in lieu of 3,5 m from the street boundary (Ocean View Drive). </li><li>3.5. Item 22(d): To permit the proposed swimming pool to be 0 m in lieu of 3 m from the eastern common boundary. </li><li>3.6. Item 22(e): To permit external windows and doors facing onto a common boundary to be 0 m and 0,3 m in lieu of 1,5 m from the eastern common boundary. </li><li> 4. <strong>City Approval: </strong></li><li>4.1.
