<br>To permit the raised parking area within the 5 m setback from Main Road.
<br>To permit the roof of the centre that is over 10 m in height to be setback 3 m in lieu of 4,5 m from the Western common boundary.
<br>To permit the walls along the street boundary over 2,1 m in height and permeability of 0%.
<br>To permit a main entrance carriageway crossing width of 10 m and delivery yard carriageway crossing width of 22 m in lieu of 8 m. </li></ul><p>Note: In terms of Section 9 of the Municipal Planning By-law (2023), the proposal does not comply with a Municipal Spatial Development Framework in that the proposed shopping centre is located within an area designated as a ‘floodplain area’ and within a ‘medium-risk coastal inundation area’, and ‘other natural area (buffer 1)’ as well as ‘an area under investigation as heritage area’. </p><p>Note: In terms of Section 16 (1) of the Municipal Planning By-law, the proposal does not comply with a district spatial development framework, being the Southern District Plan (2023), in that the proposed shopping centre is located within an area designated as a ‘Structuring Open Space’, within a ‘Proposed Heritage area’ and as an ‘Other Natural Area (Buffer 1)’ and a flood zone. </p>
