Additionally, the development parameters of the <a href="http://www.capetown.gov.za/work%20and%20business/planning-portal/regulations-and-legislations/the-city-of-cape-towns-development-management-scheme">Development Management Scheme (DMS) </a>(zoning scheme) are also encroached upon. The following applications are required:</p><ul><li>Section 42(g) in terms of the MPBL for the removal of restriction relating to the one dwelling clause, 50% built upon area and building line setback, </li><li>Section 42(j) in terms of the MPBL to delete conditions of an existing approval relating to the one dwelling clause, 50% built upon area and building line setback. </li><li>Section 42(b) in terms of the MPBL for a departure from: <br>Item 22(d) of the DMS: <br>To permit the building to be 1,50 m in lieu of 3,00 m along the southern common boundary, <br>To permit the building to be 1,864 m I lieu of 3,00 m along the eastern common boundary. <br> Item 22 (c) of the DMS: <br>To permit the building (main dwelling) beyond 12 m from the street for the portions of the buildings within the 3 m common boundary to be 6,713 m (eastern common boundary) and 6,7 m (southern common boundary) in lieu of 4 m above existing ground level. <br>In terms of Item 140(2)(a) of the DMS to permit two carriage way crossings in lieu of one. </li></ul>
